IN MEMORIAM Noah P. Cardenas February 15, 1977-January 4, 2001 family's torn apart sorrow break our tender hearts you Noah, we always will smile that you fulfill our hearts with so much love Again.one day we'll see you up above Elgin, about 55 miles southeast of Tucson. He's also charged with shooting his adoptive father, Andrew McMullen, and younger brother, Jack, during the same attack. Jonathan confessed to the crimes during testimony at his friend's December hearing, taking the stand without the official promise of a plea bargain from prosecutors. The boy sentenced Thursday had confessed to his role in a videotaped interview with police that was replayed during his hearing.

Andrew McMullen asked Santa Cruz County Superior Court Judge Anna MontoyaPaez for the maximum sentence. McMullen said that while he has not seen any signs of remorse from his adoptive son's friend, he has forgiven him. "I am not going to have that get in the way of my relationship with my family and my Lord," said McMullen, who declined to comment afterward because of his adoptive son's pending case. Montoya-Paez said yesterday that her sympathy is with both the McMullens and with Jonathan's friend, who learned about violence from his family. The judge said it is "chilling" to consider that the young defendant and Jonathan McMullen "played a game of rock-paper-scissors to determine the fate of a human life." She was referring to earlier testimony by the two teens, who said the game determined who would pull the trigger.

The friend's mother, Carmen Martinez, yesterday described the grim home life of the boy, the oldest of her three children. She said she divorced her son's father before the child was born, and that her son never developed a relationship with him. Martinez said that when her son was 5, her brother was arrested for his involvement in a drive-by shooting, a crime her son knew about and asked about. And, recently, she started dating an ex-convict named Leonard Bacon, who had just been released after serving a 12-year prison term. Records show the boy was present in June when Bacon allegedly murdered his mother, Olympia Bacon, in Bowie.

The 33-year-old man now awaits trial in Cochise County on charges of first-degree murder. Bacon reportedly took Martinez and I her children to New Mexico, where he was arrested in July. At that time, the boy was taken into protective custody and eventually placed in foster care with a friend of the McMullens. Martinez, who declined to comment after, the hearing, said she hopes her son "learns from this mistake, that he finds out that this is not the way life is, that there is more to life than being locked up." Leslie Eastman, the boy's court -appointed advocate since July, testified the 13- year-old is "a good kid in a lot of ways" but that he "has trouble discerning what is right and wrong sometimes." The teen, who was also found by Montoya-Paez to have hindered prosecution and unlawfully used a means of transportation, was ordered to pay $10,000 in restitution to the McMullen family. 77, of Tucson, AZ passed peacefully on December 13, 2001 surrounded by his family.
